Swimming pool safety standards are in place to significantly reduce the risk of young children entering the pool area without supervision. As a pool owner, you are legally obligated to ensure your pool is fenced and meets these safety standards. The standards cover critical aspects like:
Fence specifications: This includes the required height and strength of pool fences.
Non-climbable zones: Areas around the fence designed to prevent children from gaining a foothold.
Gates: Requirements for self-closing and self-latching mechanisms on all pool gates.
Building access: Measures to prevent direct, unsupervised access to the pool area from any building.
Mandatory signage: Specific signs that must be displayed in the pool area.
Penalties for Non-Compliance
It's crucial that your pool complies with all safety standards. Your local council has the authority to inspect your pool for compliance and can issue fines if it doesn't meet the requirements. Furthermore, you are required to register your pool with the QBCC. Failing to do so can also result in a fine.

Frequently Asked Questions
All answers are based on the current QLD pool safety laws (Building Act 1975, Queensland Development Code MP 3.4, Australian Standard AS 1926, and QBCC guidance). These are applicable throughout QLD

Any object a young child could use as a foothold to climb the barrier qualifies — including outdoor BBQs, furniture, pot plants, trees/branches, garden beds, toys, taps/pipework, steps/ledges, air-conditioning units or any other structure within 900 mm of the outside of the pool fence (or 300 mm on the inside).
QBCC
Yes — a boundary (dividing) fence can form part of the pool barrier if it meets the pool safety standard: minimum 1200 mm high, non-climbable zones applied, gaps ≤ 100 mm, and appropriate non-climbable treatment of adjoining rails.
When selling a property in Queensland with a pool, you must either have a current Pool Safety Certificate (Form 23) issued before settlement or provide a Form 36 Notice of No Pool Safety Certificate before contract advising the buyer they must obtain one after settlement.
All pools — including older ones — must meet the current pool safety standard (minimum 1200 mm fence height measured from finished ground level) when being sold or leased. Older exemption deadlines ended in 2015.
Yes — if the retaining wall forms part of the barrier and meets the height and non-climbable requirements (≥ 1200 mm above ground level and no climbable footholds near it)
Inspectors check that gates automatically self-close and self-latch from any open position and that latches are not readily opened by young children. They must not be propped open.
No — all materials must comply with the same standards: ≥ 1200 mm height, ≤ 100 mm gaps (bottom and verticals), and non-climbable zones maintained. Different materials must still meet those technical specs.
Many pool barrier compliance issues in rental properties are as a direct result of lack of regular maintenance and upkeep of and around the pool barrier.
Common non-compliances include weathering boundary fences, objects within the non-climbable zones left in place by tenants, gates that don’t self-close/latch, vegetation or structures kids can climb, and old/damaged/missing CPR signs
Yes — any spa or portable pool capable of holding ≥ 300 mm of water must be registered, fenced (if outdoors), and compliant with pool safety standards
Yes — a current CPR sign meeting QBCC specifications must be displayed in a prominent location inside the pool area
Not if it provides direct access to the pool area. Access must be via a compliant pool gate. Windows/doors opening into the pool without compliant screening are also non-compliant.
There are also specific laws that dictate whether or not you must have pool compliant fencing on your balcony, or if you can use standard height balustrades instead
The fence must be ≥ 1200 mm at all points above finished ground level, even on slopes or steps — ensuring a continuous barrier compliant with the safety standard.
A pool safety certificate is valid for 2 years for a non-shared pool (most homes) and 1 year for a shared pool.
The owner/landlord must ensure the pool and safety barrier comply. Tenants must keep gates closed, keep climbable objects away, and report any issues.
Yes — each regulated pool must have its own pool safety certificate before selling or leasing, regardless of body corporate arrangements.
When selling or leasing, the pool must be brought up to current standards to obtain a valid safety certificate. If not compliant, a non-conformity notice will list required rectifications.
Yes — doors/ windows that open directly into a pool without compliant screens (≤ 100 mm opening or fixed security screens) are non-compliant.
Key locks are insufficient, so a permanent fitting or fixture limiting how far these open is required
Timing varies by inspector availability, but legally you must have the certificate before settlement if selling. Booking early is strongly advised. (Timeframes are set by inspector availability, not by law.)
Councils and QBCC can issue fines and enforcement notices for non-compliance. Penalties can range from on-the-spot fines to higher court-imposed fines under the Building Act & local laws.
